Active Match App: Terms & Conditions

1. Registration Obligations

1.1 Certain areas of the Active Match App require registration to access Restricted Areas. By registering, You represent and warrant that: (i) You are eligible for an account as set forth in these Terms; and (ii) the information You include as part of the registration process is accurate and not misleading. Accounts may be obtained and used only by: (i) individual, independent persons who are eighteen (18) years old or of legal age in their country of residence if such age exceeds eighteen (18); (ii) those individuals whose registration has been authorised either by their parents or legal guardian if they are below the legal age in their respective country of residence; or (iii) individuals with the right and authority to act on behalf of an organisation or entity for the purposes of accessing and using the Active Match App.

1.2 In respect of Your use of these Restricted Areas, You agree to: (i) provide true, accurate, current and complete information about Yourself as prompted by the registration form (‘Registration Data’); and (ii) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. You can access Your Registration Data by accessing the app.

1.3 If You provide, or Healthy Stadia has reasonable grounds to suspect that You have provided, any information that is untrue, inaccurate, not current or incomplete, or Healthy Stadia otherwise reasonably considers that You have failed to comply with any provisions of these Terms, Healthy Stadia has the right to immediately suspend or terminate Your account and refuse You access to any and all current or future use of the Healthy Stadia Platforms (or any portion thereof) and all associated rewards.

1.4 In order to use the Active Match App, You must have an account on the Google Play Store, owned and operated by Google Inc., or an Apple ID on the Apple app store, owned and operated by Apple Inc. Your use of the Google Play Store is governed by a separate and independent legal agreement between You and Google Inc. consisting of the Google Terms of Service (found at: http://www.google.com/accounts/TOS), the Google Play Store Terms of Service (found at: http://www.google.com/mobile/android/market-tos.html), and the Google Play Store Business and Program Policies (found at: http://www.google.com/intl/en_us/mobile/android/market-policies.html) (all together ‘Google Terms’). Your use of the Apple app store is governed by a separate and independent legal agreement between You and Apple Inc. consisting of the Apple Website Terms of Use (found at: http://www.apple.com/legal/internet-services/terms/site.html), the iTunes store Terms of Sale and Terms and Conditions (found at http://www.apple.com/legal/internet-services/itunes/us/terms.html#service), and the Apple App store Terms of Sale and Terms and Conditions (found at: http://www.apple.com/legal/internetservices/itunes/appstore/jm/terms.html#SERVICE) (all together ‘Apple Terms’. Healthy Stadia disclaims any liability in respect with these accounts and related regulations.

1.5 You may not access or use the Active Match App if You do not comply with the Google Terms or Apple Terms. These Terms shall prevail in case of contradiction with the Google Terms or Apple Terms.

 

2. Rules

2.1 Competition Eligibility

2.1.1 The Promoter is: European Healthy Stadia Network CIC, a UK-based NGO that works to develop sports stadia as health-promoting environments, having an address of 151 Dale Street, Liverpool, L2 2JH, United Kingdom. Apple Inc. is not involved in any way with either the Promoter or the competition.

2.1.2 The competition is open to all residents from Europe aged 18 years and over, with the exception of employees of the Promoter, their close relatives and anyone otherwise connected with the organisation or judging the competition. This competition is not open to UEFA staff and members of the local organising committee.

2.1.3 The Promoter is not responsible for any physical, psychological, financial or data loss or damage whatsoever or howsoever caused by entrance into the competition.

2.1.4 There is no entry fee and no purchase necessary to enter this competition.

2.1.5 By entering this competition, an entrant is indicating their agreement to be bound by these terms and conditions.

2.1.6 For each completed journey or part-journey to a host stadia on foot or by bicycle between Sunday 16th July and Sunday 30th July for a group fixture or Quarter Final at UEFA Women’s EURO 2017 tournament, entrants will receive one (1) token for one (1) entry into the prize draw. A maximum of one token will be awarded per fixture. Multiple tokens can be awarded for completed journeys at separate fixtures.

2.1.7 Minimum valid journey distance for entry into the competition is 1,000m or 1km. Using more than one type of transportation during your journey to a host stadia on a match day, such as walking in combination with public transport, will be permitted providing a minimum of 1,000m or 1km has been achieved by walking or cycling.

2.1.8 Closing date for eligible journeys will be midnight GMT Sunday 30th July after the last Quarter Final at UEFA Women’s EURO 2017. The app will not facilitate trips to Semi-Finals or the Final and any journeys to host stadia during these fixtures will not be deemed eligible.

2.1.9 No responsibility can be accepted for entries not received for whatever reason.

2.1.10 The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.

2.1.11 The competition winners will be selected at random by Healthy Stadia. Each entrant can only win one (1) prize and only one (1) prize shall be awarded per household.

2.1.12 Any entrants suspected of fraudulent activity will be automatically disqualified.

2.1.13 The winners will be notified by email on Monday 31st If the winners cannot be contacted or do not claim their respective prize within 48 hours of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.

2.1.14 In the event an individual under the age of eighteen (18) years wins a prize, the participation in the competition has to be confirmed and the prize has to be accepted by his/her parent or legal guardian and, if the prize is tickets to a match, the Minor has to be accompanied by a parent or legal guardian. Healthy Stadia has the right in its sole discretion to amend or not to allocate a prize won by any individual under the age of eighteen (18) years.

2.1.15 Any personal data relating to the winners or any other entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

2.1.16 The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.

2.1.17 Healthy Stadia reserves the right to alter competition eligibility criteria at any time. You must review these Terms at: http://healthystadia.eu/active-match-app-terms-conditions on a regular basis to keep Yourself informed of any changes.

2.2 General

2.2.1 The competition and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.

2.2.2 The Promoter will not be required to reimburse any expense incurred by the entrants or winners of the competition.

2.2.3 Entry into the competition will be deemed as acceptance of these terms and conditions. Prizes include:

  • 2 VIP package tickets for the UEFA Women’s EURO Final
  • 5 standard tickets for the Final
  • 1 signed tournament match ball
  • 25 official tournament match balls

2.2.4 The information provided by the Active Match App is not intended to replace the information provided on the road or pedestrian areas, such as travel direction, time based restrictions, lane restrictions, road blockades, traffic signs, traffic lights, police instructions, etc.

2.2.5 Some features of the Active Match App make use of location and route information, for example in the form of GPS signals and other information sent by your mobile device on which the Active Match App is installed and activated.  These features cannot be provided without utilising this technology.

2.2.6 The Internet connection required to use the Service, and any associated charges (e.g. mobile data expense) incurred by your use of the Active Match App are your exclusive responsibility and made solely at your expense. The expense of such connections are as prescribed by the agreement between you and your mobile telephone service provider, and according to its applicable terms of payment.

3.Trademarks And Copyright Information

3.1 The UEFA logo, the emblems and mascots of UEFA competitions, the UEFA event marks and product and service names are trademarks and copyright material of UEFA (‘UEFA Marks’) and Healthy Stadia have been granted permission to use them for the purposed of the Active Match App.

3.2 Nothing in the Active Match App is designed to grant any licence or right to use any UEFA and/or Third Party Content, names, logos, pictures or trademarks other than provided in the present Terms.

4. Copyrights And Copyright Agents

4.1 Healthy Stadia respects the intellectual property of others. If You believe that any of Your intellectual property rights have been infringed through this App, please provide Healthy Stadia with the following information: name, email address, organisation, type and extent of infringement in the subject and message fields via the contact form at: http://healthystadia.eu/contact/

5. Termination

5.1 Healthy Stadia may, in its sole discretion and without liability to You, with or without cause, in particular if You do not comply with these Terms, the Google Terms, or the Apple Terms, with or without prior notice and at any time:

5.2 Terminate Your access (whether restricted or not) to the Active Match App in whole or in part.

5.3 Deactivate or delete any of Your accounts and all related information and files in such accounts as well as Your User Submissions.

MOBILE PRIVACY POLICY

PRIVACY POLICY MODEL FOR MOBILE APPLICATIONS

This privacy policy governs your use of the software application Active Match

(“Application”) for mobile devices that was created by Healthy Stadia CIC Ltd.

What Information Does The Application Obtain And How Is It Used?

User Provided Information

The Application obtains the information you provide when you download and register the Application. Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by the Application unless you register with us.

When you register with us and use the Application, you generally provide (a) your name, email address, age, user name, password and other registration information; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help.

We may also use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions.

Automatically Collected Information

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

Does The Application Collect Precise Real Time Location Information Of The Device?

When you visit the mobile application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city you are located within and display a location map with relevant advertisements. We do not share your current location with other users or partners.

If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application.

Do Third Parties See And/Or Have Access To Information Obtained By The Application?

Only aggregated, anonymized data is periodically transmitted to external services to help us improve the Application and our service. We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose User Provided and Automatically Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.
  • If Healthy Stadia CIC Ltd is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

 

What Are My Opt-Out Rights?

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. Data Retention Policy, Managing Your Information

We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to six months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at: info@healthystadia.eu  and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 18. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at: info@healthystadia.eu

We will delete such information from our files within a reasonable time.

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavour provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes
